Clerk-recorder candidate Barry Pruett submitted his candidate statement for the Voter Information Pamphlet with this language:
“Over the past years, the Nevada County Clerk-Recorder’s office become an embarrassment. We need new management. Let’s stop the drama and put professional management in charge.”
He submitted this statement despite words in the Election Code (Section 13307) that any candidate’s statement “shall not in any way make reference to other candidates for that office or to another candiate’s qualifications, character or activities.
“The elections official shall not cause to be printed or circulated any statement that the elections official determines is not so limited or that includes any reference prohibited by this section.”
Assistant clerk-recorder Gail Smith said, “I immediately informed Mr. Diaz, the clerk-recorder, that I believed there to be a problem with Mr. Pruett’s statement, and I requested to handle the situation without him, and Mr. Diaz agreed. At no point was Mr. Diaz involved in the deliberation process. I alone worked closely with the county counsel’s office to make this decision.”
Smith said she called Pruett to inform him of the decision.
Doesn’t Barry know the Election Code? It is very clear on matters like this. How much time was spent by the assistant clerk-recorder and county counsel conferring on this matter?
For the record, Barry was endorsed by Sierra College Trustee Aaron Klein, among others. Barry’s wife works for Tom McClintock’s campaign. At a recent Tea Party Patriot rally, McClintock allegedly said it’s time to get rid of that “left-wing” clerk recorder.
The election isn’t even until June, so we can expect more controversies to erupt.
